These terms govern the consumer's withdrawal from a distance purchase contract, in particular for an order placed through the Wolt or Bolt Food service where Peter Kurtulík or Intim Shop is stated as the seller for the particular order.

2. When the consumer has the right to withdraw
For a distance contract, the consumer has the right to withdraw from the contract without giving any reason within 14 days of receiving the goods.
If the goods from one order are delivered separately, the period starts to run on receipt of the last delivered goods. If one product consists of several parts or pieces, the period starts to run on receipt of the last part or piece.
The consumer may also withdraw from the contract before receiving the goods.
The period is met if the consumer sends the notice of withdrawal no later than on the last day of the 14-day period.
3. Purchases in the physical store
The right to withdraw from the contract without giving a reason within 14 days does not apply to goods bought in person in the physical store.
When buying in the shop, the customer has no statutory right to return non-defective goods merely because they changed their mind or the product does not suit them.
This does not affect the customer's rights arising from liability for defects in the product.
4. When it is not possible to withdraw from the contract
The consumer cannot withdraw from the contract for the supply of goods sealed in protective packaging which are not suitable for return for health protection or hygiene reasons, if that protective packaging was broken after delivery.
This exception may apply in particular to sex toys and intimate and hygiene products, if:
- the product was delivered in sealed or other demonstrable protective packaging,
- the protective packaging was broken after delivery,
- after the protective packaging has been broken, the product cannot be put back on sale for hygiene or health reasons.
Merely opening the outer shipping bag, box or packaging used only to deliver the order is not considered a breach of the product's protective packaging.
The impossibility of withdrawing from the contract does not concern a complaint about a defective product. Even an unwrapped or used product can be complained about if it has a defect for which the seller is liable.
5. How to withdraw from the contract
The consumer may withdraw from the contract by an unequivocal statement making clear that they wish to end the contract.
The notice of withdrawal can be sent:
- by email to intimshop@intimshop.sk,
- by post to Peter Kurtulík, Prievozská 1308/17B, 821 09 Bratislava-Ružinov,
- using the withdrawal function available in the online interface in which the order was placed.
The consumer may also use the sample form below. Using the form is not mandatory.
We recommend stating the order number, the identification of the goods and your contact details in the notice so that the withdrawal can be correctly matched to the specific purchase.
The burden of proof that the withdrawal was sent in time lies with the consumer. We therefore recommend keeping the email, the confirmation from the app or the proof of posting.
6. Returning the goods
The consumer is obliged, no later than 14 days from the day of withdrawal from the contract, to:
- hand the goods over in person at the Intim Shop store at Prievozská 17 in Bratislava or
- send the goods to Peter Kurtulík, Prievozská 1308/17B, 821 09 Bratislava-Ružinov.
The period is met if the consumer sends the goods no later than on the last day of this period.
The direct costs of returning the goods are borne by the consumer.
We recommend returning the goods complete, safely packed and together with all the accessories supplied. The original retail packaging is not a general condition of withdrawal; however, where it is hygienic protective packaging, breaking it may lead to the loss of the right of withdrawal.
The consumer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature and functioning.
7. Refund of payments
The seller will refund to the consumer, no later than 14 days from the day of receiving the notice of withdrawal, all payments received in connection with the contract concerned.
If the consumer also paid delivery costs, the seller will refund the costs corresponding to the cheapest standard delivery method that was offered when the order was placed.
If the consumer chose a more expensive delivery method, the difference between it and the cheapest delivery method offered is not refunded.
The seller is not obliged to refund the payments before:
- the goods are returned to them or
- the consumer proves that they have sent the goods back,
whichever happens first.
Payments will be refunded in the same way the consumer used to pay, unless the consumer agrees with the seller on another method without additional fees.
For an order paid through the Wolt or Bolt Food service, the refund may technically be made through the relevant platform or the payment service used.
8. Withdrawal and a complaint are not the same thing
Withdrawal from the contract without giving a reason serves for returning non-defective goods bought at a distance, unless a statutory exception applies.
A complaint concerns a product that has a defect.
Breaking the hygienic protective packaging may exclude the right to withdraw from the contract, but it never automatically excludes the right to complain about a defective product.
